Resumen La regulación del "Testamento Vital", de muy reciente inclusión en el sistema legal español, y de gran actualidad y concisión, carece, sin embargo, de una previsión legal en lo que se refiere al incumplimiento del mismo por parte de los Profesionales de la Medicina. Se constata que de forma, tal vez, voluntaria el legislador ha eludido introducir una norma que sancione el voluntario incumplimiento de lo que dispuso validamente el ahora agonizante, precisamente, para las atenciones que quisiera o que no quisiera recibir en sus últimos momentos. Para el autor, Ramón Maciá Gómez, es precisa una reforma del Código Penal que prevea como infracción penal tal incumplimiento. Abstract (The Vital Testament: Its value and its entailment) The regulation of the "Vital Testament" ("living wills"), of very recent inclusion in the Spanish legal system, and whit an important actuality and concision, lacks, nevertheless, a legal provision concerning the breach of the same one by the part of the Professionals of the Medicine. The legislator has eluded to introduce a legal norm that penalizes or sanctions the voluntary nonperformance of what had validly, the now agonizing, precisely, for the attentions that he wanted, or that did not want, to receive in his last moments. For the author. Ramón Maciá Gómez, there is precise a reform of the Penal Code that provides like penal infraction such breach or nonperformance of the living wills.
